Why Kalshi is legal in California when sportsbooks are not
California voters rejected both sports-betting ballot measures in 2022 (Propositions 26 and 27), and no online sportsbook — DraftKings, FanDuel, or anyone else — is licensed to operate in the state. Prediction markets are a different legal category: Kalshi is a CFTC-regulated derivatives exchange, and federal commodities law, not state gambling law, governs who it can serve. That is why Californians can trade event contracts on everything from elections to sports outcomes while the sportsbook apps remain geofenced out.

What the fees look like
Kalshi's taker fee is price-dependent (it peaks on 50-cent contracts and shrinks toward the extremes), and there is no commission layer on top when trading direct. A standard -110 sportsbook line embeds roughly 4.5% of implied probability as margin — Californians comparing the two will usually find the exchange fee lower and fully disclosed.

Exchange-side taker fees per each venue's published formula (rate × contracts × price × (1 − price), Kalshi rounds the order total up to the next cent). Fees peak at 50¢ and shrink toward the extremes. Most quoted cross-venue “arbs” are negative-EV after these fees — the taker-fee breakeven on a Kalshi/Polymarket pair is roughly 3.5–4¢.
